The following agreement is effective from 1 January 2006.

Hanson Park Ltd provides an Internet hosting service.

Hanson Park Ltd reserves the right to suspend or cancel a customer's access to any or all services provided by Hanson Park Ltd when Hanson Park Ltd decides that the account has been inappropriately used or otherwise.

SERVICE USE

Hanson Park Ltd reserves the right to refuse service and / or access to its servers to anyone.

Hanson Park Ltd does not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any UK, European or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Hanson Park Ltd. Also includes any sites which provide "links to" information about such material or advertising for such material.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

HIGH RESOURCE USER POLICY

Resources are defined as bandwidth and/or processor utilization. Hanson Park Ltd may implement the following policy to its sole discretion: When a website found to be monopolising the resources available, the account holder will be contacted in order to discuss the situation. If no arrangement can be reached, Hanson Park Ltd reserves the right to terminate the account.

CANCELLATION

Hanson Park Ltd reserves the right to cancel services at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of hosting. This excludes domain registration which will not be refunded. If a full refund is given then all rights to the registered domain will pass to Hanson Park Ltd. If a customer contravenes Hanson Park Ltd's terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time, by giving 1 months notice in writing. No refunds on the remaining period will be given.

Fees charged for additional services are on a prepay basis, refunds will be given at the discretion of the company management.

INDEMNIFICATION

Registered users agree that it shall defend, indemnify, save and hold Hanson Park Ltd harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Hanson Park Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Hanson Park Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Hanson Park Ltd servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Hanson Park Ltd servers.

DISCLAIMER

Hanson Park Ltd will not be responsible for any damages your business may suffer. Hanson Park Ltd makes no warranties of any kind, expressed or implied for services we provide. Hanson Park Ltd disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Hanson Park Ltd and its employees. Hanson Park Ltd reserves the right to revise its policies at any time.

PAYMENT TERMS

Fees and Payments

a. All fees are payable in UK Sterling. All payments are due on your account's Bill Day (See"Billing Cycle", for more information).

b. Payment will be by direct debit or standing order and each month's service is payable in advance on the last working day of the preceding month.

Billing Cycle

Your "Bill Day" is the last working day of the preceding month.

Failure to Pay

Your failure to fully pay any fees and taxes within fifteen (15) days after the applicable due date will be deemed a material breach of this Agreement, justifying Hanson Park Ltd's immediate suspension of its performance of the Services and/or termination of this Agreement. You are responsible for any fees associated with reinstating the Services. Any such termination would not relieve you from paying past due fees. In the event of collection enforcement, you will be liable for any costs associated with such collection, including, without limitation, legal fees, court costs and collection agency fees.
